1. Who these terms are with
These terms are an agreement between you and Poise, covering the Poise mobile app and the services behind it. By using the app you accept them. Our Privacy Policy explains what we do with your data and forms part of these terms.
2. Eligibility and your account
- You must be at least 18 to use the app, and you confirm that you are.
- An account is required. You create one with Sign in with Apple or Sign in with Google at the end of onboarding, and you are responsible for keeping access to it secure.
- One account per person. The answers you give during onboarding decide which events you are shown, so keep them accurate.
- The app is for your personal, non commercial use.
3. What Poise is, and what it is not
Poise shows you dating and social events, and clubs, run by independent hosts in your city, and sends you to those hosts to book. It also includes a subscription with a deck of practice challenges and a set of lessons that are ours.
We are a listings service. We are not the organiser of any event or club in the app, we do not run them, staff them, or take your money for them. Section 4 sets out what that means in practice, and it is the most important section in this document.
The practice challenges and lessons are a self improvement tool. They are not medical, psychological or therapeutic advice, diagnosis or treatment, and they are not a substitute for professional care. If you are struggling, please speak to a qualified professional or your local emergency service.
4. Events and clubs are run by other people
Every event and club listed in the app belongs to a third party host. When you tap the button on a listing you leave the app for that host's own website.
- Your booking is with the host, not with us. Tickets, memberships and applications are sold and accepted by the host on their own site, under their terms and their privacy policy. Read them.
- Prices, dates, venues, age limits and entry rules are the host's, and they can change them or cancel at any time. A host may refuse entry under their own rules. Some listings are for a specific age range or for particular people, as shown on the listing.
- Refunds, transfers and complaints about an event go to the host. We cannot refund a ticket we never sold.
- Registering interest in a club is not a booking and does not reserve you a place. It puts you in front of the host, who decides.
- We do not vet hosts, venues, staff or the people who attend, and we make no promise about the quality or safety of any event, or that it will happen at all, or that anyone else will turn up.
- Listing details may be wrong or out of date. We take them from the host. Always check the host's own page before you travel or pay.
To the fullest extent the law allows, we are not responsible or liable for any event or club, for anything a host does or fails to do, or for anything that happens before, during or after one.
5. Your conduct and your safety (please read carefully)
The app leads to meeting people in real places. You are responsible for your own conduct and your own safety, and you agree that:
- you will act lawfully, respectfully and consensually at all times;
- you will not harass, intimidate, stalk, deceive, coerce or pressure anyone, and you will accept it when someone is not interested;
- you will use your own judgement about where, when and with whom you meet, and take sensible precautions, including telling someone where you are going;
- you will follow the host's rules and the venue's rules while you are there;
- you will not use the app to arrange or assist anything unlawful, dangerous or harmful.
To the fullest extent the law allows, you take on the risks of meeting people in person, and we are not responsible or liable for the conduct of any other person, at an event or anywhere else.
6. Your data and erasing it
What we collect and why is set out in the Privacy Policy. Your data is held on your device and in your account so it can follow you to a new phone. You can erase all of it, including the account itself, at any time with Erase all my data in Settings.
7. Subscriptions, billing and cancellation
- What is paid. Browsing events and clubs is free. The practice deck, the lessons and the progress screens need a subscription. Current prices and plan lengths are shown in the app before you buy.
- Who bills you. Apple on iPhone, through your App Store account. Google on Android, through Google Play. We never see your card details.
- Auto renewal. Subscriptions renew automatically at the then current price unless you cancel at least 24 hours before the end of the period. Your store account is charged within 24 hours of the end of the period.
- Managing and cancelling. You manage and cancel in your App Store or Google Play account settings, not in the app.
- Refunds are handled by Apple or Google under their policies, alongside your statutory rights. We generally cannot refund directly.
- Price changes. We may change prices. Changes apply to future billing periods, and where the law requires it we will tell you and ask for your consent.
- Introductory offers are set in the App Store or Google Play and are shown in the app when you are eligible for one.
8. Acceptable use
You agree not to reverse engineer, copy or resell the app, interfere with its operation or security, use it to break the law, scrape or harvest listings or data, create accounts in bulk, inflate a host's interest numbers, or misrepresent who you are.
9. Intellectual property
The app and its contents, excluding material belonging to hosts, are owned by us or our licensors and are protected by law. We grant you a limited, personal, non transferable, revocable licence to use the app under these terms. Listing text and images belong to the host who supplied them.
10. Third party services and links
The app relies on third parties, including Apple, Google, RevenueCat, Supabase and our analytics provider, and it links out to hosts' own websites and ticketing platforms. Those services have their own terms, and we are not responsible for them or for anything on a site we link to.
11. Disclaimers
To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, and without any promise that it will be uninterrupted, error free, or that any listing is accurate.
12. Limitation of liability
To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from an event or club, from a host, or from meeting anyone in person. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty pounds. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.
13. Indemnification
You agree to indemnify us against claims, losses and expenses arising from your use of the app, your conduct in person, or your breach of these terms.
14. Suspension and termination
We may suspend or end your access if you breach these terms or to protect the app, a host, or other people. You may stop using the app and erase your data at any time. Sections that by their nature should survive termination do so.
15. Governing law and disputes
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, without limiting any mandatory consumer protection rights you have where you live.
16. Changes to these terms
We may update these terms. We will post the new version with a new date and, for material changes, tell you in the app. Continuing to use the app after a change means you accept it.
17. Contact
18. Additional terms for Apple devices
These apply when you use the app on an Apple device:
- These terms are between you and Poise only, not Apple, and we, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses are our responsibility.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory claims, and consumer protection claims.
- If a third party claims the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.
- You must also comply with applicable third party terms, such as your mobile carrier's, when using the app.
19. Additional terms for Android devices
On Android the app is distributed through Google Play and subscriptions are sold by Google. Your use of Google Play is subject to the Google Play Terms of Service. Google is not a party to these terms and is not responsible for the app, but where Google Play's terms give you rights against Google, such as its refund policy, those rights are unaffected by anything here.
